H-2A opened to dairies in June 2026
In June 2026, U.S. Citizenship and Immigration Services issued guidance [June 17, 2026 - Temporary or Seasonal Need for H-2A Petitions for Dairying] that lets dairies be considered for H-2A under the same temporary and seasonal standard as any other farm, instead of being denied for looking permanent.
It does not yet cover a fully year-round workforce, and every case is judged individually. A bigger fix, a year-round agricultural visa, is moving through Congress. Until it passes, this guidance is the legal tool dairies can act on now.
