At Denizen Immigration PC, we believe in the power of persistence and advocating for what’s right. Recently, we had the privilege of helping a family reunite after a stressful visa denial that separated them across two continents.

Our client was approved for an H-2A visa, and his wife and baby were approved for H-4 visas to accompany him to the US. However, their two school-aged children were denied visas by the U.S. Consulate in Cape Town, South Africa, with the explanation that the children could be a burden on the U.S. education system (which is not a justifiable reason for denial, as H-4 visa holders are allowed to go to school).

When they came to us, the parents were already in the U.S. due to time sensitive nature of the work, while their children remained in South Africa. It was an incredibly emotional and time-sensitive case, and we knew we had to act quickly.

First, we sought a supervisor review of the case, which was denied. Undeterred, we pushed forward and reapplied. After a third interview at the consulate, the children’s visas were finally approved, reuniting the family in the U.S.

This case is a powerful reminder that sometimes, the third time really is the charm! We’re proud to have played a part in bringing this family back together and ensuring they could start their new journey in the U.S. as one.
